Background: The works required excavation for foundations within 3 m of the adjoining owner's property and below the level of the adjoining owner's foundations.
Instead of making a Party Wall Surveyor appointment, the two neighbours came to an understanding between themselves that the adjoining owner would 'consent' to the works and hence only a Schedule of Condition was required.
There was one adjoining owner to the works and he 'consented' to the works outlined in the Notice.
The works involved the erection of a ground floor rear extension.
Conclusion:
The Party Wall Surveyor's role is to resolve disputes between neighbours. Where the neighbours are not in dispute there is no statutory role for a Party Wall Surveyor to play.
The parties requested that an ancillary service be provided, namely that the current condition of the adjoining owner's property be recorded by way of a written and photographic report (a Schedule of Condition) so that in the eventuality that damage resulted from the works he could properly compensate the Adjoining Owner. So we provided this service as a standalone.
