Background: The proposed foundations works were to be about 1 m distant from the adjoining owner's structures.
We were appointed by the building owner. The adjoining owner did not respond to the Notice with the statutory periods following which the building owner made a statutory appointment of a Surveyor on behalf of the adjoining owner.
There was one adjoining owner to the works.
The works involved the erection of a ground floor extension to the rear of the house.
Conclusion: The adjoining owner did not respond to the Notice within the 14-day statutory period, nor to the '10-day letter' that followed so the building owner had to appoint a Surveyor on behalf of the adjoining owner.
We managed to make contact with the adjoining owner and arrange for a Schedule of Condition to be undertaken of their property. Following that, the Award was served in the normal way.
The main issue addressed in the Award was the necessity for the foundations to be excavated by hit and miss sequenced foundations.
