Background: The works required excavation for foundations within 3 m of the adjoining owner's property and below the level of the adjoining owner's foundations and also the erection of a flank wall on the line of junction.
As the two adjoining owners consented to the works, only a Schedule of Condition was required.
There were two adjoining owners to the works and both consented to the works outlined in the Notices.
The works involved the erection of a ground floor rear extension.
Conclusion:
The adjoining owners consenting to the works is a very obvious benefit to the building owner as his Party Wall costs are thereby roughly halved. Following consent, the Surveyor undertakes a Schedule of Condition but does not produce an Award. The reduction in Surveyor involvement is reflected in the much lower fee.
When the Surveyor attended site to undertake the Schedule of Condition he found that the works had already commenced. Commencing excavation works before the Schedule of Condition is undertaken is generally best avoided.
