Background: The works required that beams be inserted into the Party Wall.

We were initially appointed by the building owners following which, the adjoining owner appointed us as Surveyor to act on their behalf as well, i.e., as 'Agreed Surveyor', in which role a Surveyor acts impartially for both neighbours.

There was one adjoining owner to the works.

The works involved loft conversion works and the formation of a rear dormer.

Conclusion:

The loft dormer was proposed to be offset from the Party Wall and its cheek was supported on a beam away from the Party Wall. The works did not therefore involve the raising of a Party Wall, but did involve cutting in to the Party Wall in order to support floor beams and a ridge beam running the width of the loft space. Removal of the roof tiles also exposed the Party Wall and the Award included provisions on protecting the Party Wall from rain ingress.

Scaffolding had been erected on the building owner's land prior to the serving of the Award. As it over sailed the land of the adjoining owner it was an unwarranted trespass, particularly as the subsequently served Award did not deem such trespass to be necessary.
