A Surveyor can be appointed as Building Owner Surveyor - acting solely as the Surveyor appointed by the person undertaking the works, as Adjoining Owner Surveyor - acting solely as the Surveyor of a property owner adjoining the works, or as the Agreed Surveyor - acting impartially for both the Building Owner and the Adjoining Owner.
When an Adjoining Owner receives a Party Wall Notice notifying him of the described proposed works, he can either 'Consent' to the works or 'Dissent' to the works. In the former case a Schedule of Condition is normally undertaken in order to record the condition of the adjoining owner's property prior to the works commencing.
In the latter case of 'dissent' the Surveyor must prepare and serve a Party Wall Award stating the works that the Building Owner is entitled to undertake in accordance with his rights under the Party Wall Act and to describe the work methods to be employed in order to minimise risk and disturbance to the Adjoining Owner.
